 A. General Terms and Conditions

1 Area of application

 1.1 These terms and conditions of "Taylor Wheels GmbH & Co. KG" (hereinafter "Seller"), shall apply to all contracts concluded by a consumer or trader (hereinafter "Customer") and the seller. It includes all goods and / or services shown in the online shop. Herewith the inclusion of the own conditions of the Client is waved, unless something else has been agreed upon.
1.2 A consumer in the sense of these General Terms and Conditions shall mean any natural person who enters into a legal transaction for a purpose which can be attributed either commercial or  independent professional activity.  An entrepreneur in the sense of these General Terms and Conditions shall mean any natural or legal person or a legal partnership, who concludes a legal transaction in the exercise of their independent professional or commercial activity.

2 Conclusion of contract

2.1 The product presentations offered in the online shop of the seller do not constitute binding offers from the seller to the customer, but intended to submit a binding offer by the customer.
2.2 The client can submit his offer via the online order form integrated in the online shop of the seller. In this case, the customer has to enter his personal data and starting the ordering process by clicking the button concluding a legally binding contract offer in relation to the goods contained in the shopping cart.
2.3 The Seller may accept the offer of the customer within five days,

- By submitting a written confirmation or confirmation in writing (fax or email) to the customer, in which the reception of the order confirmation by the customer is relevant, or

- By access of goods to the customer, or

- By asking the customer to pay his order.

If several options of the above alternatives occur, the contract is concluded at the moment when one of the above alternatives occurs first. If the seller does not accept the offer of the customer within the aforesaid period, the offer is rejected by the seller and the client is no longer bound to his declaration of intention.


2.4 Order and contact usually take place via email and automatic order processing. The customer must ensure that his or her e-mail address is correct regarding his designated order, so that e-mails sent by the seller can be received. In particular, the customer has to ensure the use of spam filters, in order to receive all messages by the Seller or that of third parties entrusted with the order handling.

3 Cancellation policy and return costs

The buyer has the right to withdraw from this contract within 30 days without giving any reason.

The buyer bears the cost of return. This does not apply if goods are not as described.

4 Prices and payment

4.1 The prices quoted by the Seller are final and include German VAT. If necessary, additional delivery and shipping costs are displayed in the product description.
4.2 For deliveries to countries outside the European Union, additional costs may occur. The seller is not responsible for these particular cases. These costs shall be borne by the customer. These can include charges for the transfer of funds through banks (eg transfer fees, exchange fees) or legal import duties or taxes (eg customs duties).
4.3 The customer can choose different payment options available, which are displayed in the online shop of the seller.
4.4 If agreed in advance, payment is due immediately upon signing.

5 Delivery and Shipping Terms

5.1 Delivery of goods occurs regularly on the shipping routes and at the delivery address specified by the customer. During completion of the transaction specified in the purchase of the vendor the shipping address is decisive. Notwithstanding the above, at the time of payment at PayPal the shipping address provided by the Customer at the PayPal payment is decisive.
5.2 If the transport company sent back the goods to the seller because the delivery was not possible, the customer bears the cost of the failed delivery. This does not apply if the customer exercises his right of cancellation, if he is not responsible for the impossibility of delivery or when he was temporarily prevented to accept the delivery, except the fact that the Seller had informed him about the delivery a reasonable time beforehand.
5.3 In general, the customer or a person authorized to receive the goods take the responsibility for any risk of accidental loss and accidental deterioration of the sold goods. If the customer is an entrepreneur, the risk of accidental loss and accidental deterioration passes on the customer when the delivery of the goods is handed over to a suitable transport person.
5.4 The Seller reserves the right to withdraw from the contract in the case of incorrect or improper delivery. This applies only if non-delivery cannot be accounted to the seller and has been completed with due diligence a transaction with the supplier. The Seller will make all reasonable efforts to procure the goods. In case of non-availability or only partial availability of the goods, the customer will be notified immediately and will be refunded immediately.
5.5 Pickup is not possible for logistical reasons.

6 Liability for defects

The German statutory liability for defects are applicable.

7 Applicable Law

7.1 The law of the Federal Republic of Germany under exclusion of the laws on international sale of goods shall apply to all legal relationships between the parties. The foregoing provisions regarding the governing law apply to consumers only to the extent that granted protection by mandatory statutory provisions of the country, in which the consumer maintains its customary residence is not withdrawn.
7.2 The contract language is German.

3 Information on the conclusion of the contract

The conclusion of the contract is in accordance with Paragraph 2 of the Seller, terms and conditions (see above).

4 Information about payment and delivery

Payment shall be made in accordance with Paragraph 4, delivery in accordance with Clause 5 of the Seller, terms and conditions (see above).

5 Information about the technical steps leading to the conclusion

The customer must go through the following technical steps to submit his bid on the online order form from the seller:

5.0.2 Register in the online shop by entering your user ID and password, or - if a customer does not yet have an account - enter the order details in the form provided for this purpose

5.1 Acceptance by the Seller shall be governed by Section 2.3 of the Seller's terms and conditions (see above).

6 Information on storage of contract

The contract will be filed by the seller and sent to the customer after dispatch of the order, together with these Terms and customer information in text form (eg letter, fax, e-mail). In addition, the text of the contract is archived on the seller's website and can be downloaded free of charge from the customer via his password, specifying the login information, given the customer has created an account in the online shop of the seller before submitting his order.

7 Information to identify the technical means to input errors and rectify

Before binding the order, the customer can correct his entries using the standard keyboard and mouse functions. Furthermore, all entries will be displayed in a confirmation window and can be corrected by means of the standard keyboard and mouse functions before confirming the order.
